RESOLUTION OF NECESSITY PROVIDING FOR THE RENEWAL OF A TAX LEVY IN EXCESS OF THE TEN MILL LIMITATION FOR FLOOD PROTECTION AND DIRECTING THE LAWRENCE COUNTY BOARD OF ELECTIONS TO PLACE ON THE NOVEMBER 3, 2020 GENERAL ELECTION BALLOT A ONE MILL RENEWAL TAX LEVY FOR FLOOD PROTECTION PURPOSES PURSUANT TO OHIO REVISED CODE SECTIONS 5705.02, 5705.19 AND DECLARING AN EMERGENCY

WHEREAS, The City Council of the City of Ironton, State of Ohio, has determined that it is necessary to renew a two (2) mill tax levy for the benefit of the citizens of Ironton, Ohio for the purpose of providing, operating, and maintaining flood protection works, to meet the needs of the citizens of Ironton, Ohio, pursuant to Ohio Revised Code Sections 5705.19(O) and 5705.12; and,
WHEREAS, The Council of the City of Ironton, Ohio has determined that funds will otherwise be inadequate for the necessary requirements of the operation of the Flood Works Protection with respect to its provision of such flood protection services, and that it is therefore necessary to enact a two (2) mill levy for the purpose of providing, operating, and maintaining flood protection services for a period of five (5) years, commencing with the tax year 2020 and continuing through tax year 2024.
NOW, THEREFORE, BE IT RESOLVED: by the Council of the City of Ironton, State of Ohio, a two-thirds majority of all members elected thereto concurring, that:
Section 1: It is hereby determined and declared that the amount of taxes that may be raised within the ten (10) mill limitation by levies on the current tax duplicate will be insufficient to provide an adequate amount for the necessary requirements of this subdivision, Ironton, Ohio, and that it is therefore necessary to renew a two (2) mill levy in excess of the said ten (10) mill limitation, pursuant to Ohio Revised Code Section 5705.02 and 5705.91.
Section 2: It is hereby determined and declared that the amount and duration of increase in the rate outside the ten (10) mill limitation, which is necessary to be renewed for said flood protection purposes, is at a rate not exceeding two (2) mill for each One Dollar ($1.00) of valuation, which amounts to twenty cents ($0.20) for each one hundred dollars ($100.00) of valuation, for a period of five (5) years, to be placed on the tax list and duplicate commencing with tax year 2020 and continuing through 2021, 2022, 2023, and 2024.
Section 3: It is hereby determined and declared that a copy of this Resolution be adopted pursuant to and in compliance with Ohio Revised Code Sections 5705.02 and 5705.191, shall be certified immediately following its adoption to the Lawrence County Board of Elections in compliance with Ohio Revised Code Section 5705.191 and 5705.25, for submission by said Lawrence County Board of Elections to the electors of the City of Ironton, Ohio, pursuant to the terms of this Resolution and in compliance with the law.
Section 4: It is hereby determined and declared that the questions of said tax levy shall be submitted to the electors of the City of Ironton, Ohio at the general election to be held November 3, 2020, as authorized by law. The Lawrence County Board of Elections is hereby requested to submit to the voters of the City of Ironton, Ohio on the November 3, 2020 General Election the following question: “A renewal tax for the benefit of the City of Ironton, Ohio for the purpose of funding flood protection services of said City at a rate not exceeding two (2) mills for each One Dollar ($1.00) evaluation, which amounts to twenty cents ($0.20) for each one hundred dollars ($100.00) evaluation on a five-year basis.”

Section 5: It is hereby determined and declared that this Resolution is an emergency measure
necessary for the public peace, health, and welfare of the citizens of Ironton, Ohio, and shall go into immediate effect upon passage and that no publication of this Resolution is necessary other than that provided for in the notice of election, pursuant to Ohio Revised Code Sections 5705.19 and 5705.25.
Section 6: It is hereby determined and declared that all formal actions of the Council of the City of Ironton, Ohio relating to the adoption of this Resolution were adopted in an open meeting of the Board, and that all deliberations of the Board that resulted in such formal actions were in meeting open to the public, in compliance with the law. The Clerk of Council of the City of Ironton is hereby directed to certify this Resolution to the Board of Elections of Lawrence County, Ohio in order that said Board of Elections may make the necessary arrangement for said submission of such question to the electors of said City on Tuesday, the 3rd day of November, 2020, as provided by law, which said date is hereby determined by this Council to be date of the submission of said questions to said electors.
