ORDINANCE RENAMING LINE ITEMS FOR FUND 42-00-8-0099-0054 AND FUND 01-15-5-0099-0054 AND DECLARING AN EMERGENCY

Whereas the within funds should be renamed,
NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF IRONTON, OHIO:
Section I: That the name of Fund 42-00-8-0099-0054 be and is hereby changed from “Transferred from General Fund” to “Advanced from General Fund”.
Section 2: That the name of Fund O l-15-5-0099-0054 be and is hereby changed from “Transferred from Storm Water Fund” to “Advanced from Storm Water Fund”.
Section 3: That this Ordinance is hereby declared an emergency measure necessary for the protection of the public safety, peace and welfare of the citizens of the City of Ironton, Ohio.
Adopted this 26th day of March, 2020.
Vetoed this 31st day of March, 2020.

Members of Council, I have decided to veto Ordinance 20-11 which renames line items for fund 42-00-8-0099-0054 and fund 01-15-5-0099-0054. I am concerned that allowing advancements out of enterprise funds sets a bad precedent for using our enterprise funds as contingency funds rather than
what they are supposed to be used for. Additionally, we have received an opinion from our Solicitors that this action is prohibited by city charter section 5.05 “Transfer of Funds” which states “Any fund which, in its entirety, is provided by tax levy or service charge shall not be
transferred to any other fund.” Therefore, I believe it is in the best interest of the city to forgo ordinance 20-11.Sincerely,
