ORDINANCE NO. 21-38

AUTHORIZING THE MAYOR TO SUBMIT FOR BID AND ACCEPT THE HIGHEST AND BEST BID FOR THE CELLULAR TOWER OWNED BY THE CITY OF IRONTON, OHIO AND DECLARING AN EMERGENCY

WHEREAS, the City of Ironton owns property where a current cellular tower is located; and,

WHEREAS, the City of Ironton has previously entered into a lease for said property with Horizon Personal Communications dated April 2, 1998; and,

WHEREAS, the lease is set to expire on April 2, 2023; and,

WHEREAS, the City desires to enter into a subsequent lease of the cellular tower to benefit the City.

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF IRONTON, OHIO:

SECTION I: That the Mayor is hereby authorized to place a Notice of Bid in a newspaper of general circulation for an easement and lease agreement for a 50-year term.

SECTION II: The lease and easement agreement shall require a minimum bid of $600,000.00 to be paid upon closing and execution of the lease on or before April 2, 2023.

SECTION III: The lease and easement agreement shall be a for a 50-year term.

SECTION IV: The lease and easement agreement shall provide for revenue sharing with a minimum of 25% of the monthly rent payments collected by the Lessee to be paid to the City of Ironton (Lessor)

SECTION V: This Ordinance shall be declared an emergency necessary for the protection of the health, safety and welfare of the residents of the City of Ironton, Ohio.
